NCHR Requests Punjab to Adopt the Hindu Marriage Act of 2017

The Hindu Marriage Act, 1995. Marriage in Hinduism

The Punjab government has been urged by the National Commission for Human Rights (NCHR) in Pakistan to take the Hindu Marriage Act of 2017 seriously, which is a significant step toward resolving a critical issue that the Hindu community faces: the lack of appropriate documents. The Act, which governs the Hindu community’s marriage, divorce, and child registration processes, has not yet been put into effect in Punjab, Balochistan, or Khyber Pakhtunkhwa, the three regions where it is applicable. The Hindu community is deprived of basic rights as a result of this law’s non-enforcement.

Communication Between NCHR and the Punjab Government

The NCHR has been in proactive communication with the Chief Secretary’s Office in Punjab, and a subsequent hearing is scheduled for late January 2024. The commission has fervently pressed for the prompt appointment of Hindu Marriage Registrars, potentially designating secretaries of Union Councils, to streamline and accelerate the registration process.

Challenges and Solutions in Implementing the Hindu Marriage Act 2017

The National Commission for Human Rights (NCHR) has identified bureaucratic delays and a widespread lack of awareness as the primary impediments to the effective implementation of the Hindu Marriage Act 2017. These hurdles have created a significant gap between the legislative intent and the practical execution of the law.

In response to these challenges, the NCHR advocates for a comprehensive strategy to ensure the Act’s successful implementation. This strategy involves streamlining processes, launching awareness campaigns, providing sensitization training for officials, and fostering collaboration with civil society organizations. By actively addressing these issues, the NCHR aims to protect and uphold the rights of the minority community.

The NCHR’s proactive intervention underscores its commitment to safeguarding minority rights in Pakistan. If successfully implemented, the Hindu Marriage Act 2017 has the potential to bring about a profound improvement in the lives of the Hindu community, contributing to a more inclusive and equitable society.
